Delhi and its Car Ownership Transfer Regulations

Delhi is undoubtedly one of the biggest consumer marketplaces for the auto industry in India. That being said, holds good for both used and new vehicles. Various factors should be taken into consideration in case you have bought or are planning to buy a used car in the capital city of India. One of the most crucial factors is the transfer of ownership of the car/vehicle. There are 13 Regional Transport Offices or RTOs in the city of Delhi wherein you can apply for and get the ownership of a pre-owned car/vehicle transferred easily.

Documents Required for the Ownership Transfer Process in Delhi

The paperwork needed for the procedure of ownership transfer of a car in Delhi is as follows:

  • Copy of valid insurance certificate
  • Original Registration Certificate of the vehicle
  • Copy of a proof of address - voter ID card, passport, utility bills, ration card, and so on
  • Copy of valid Pollution Under Control (PUC) certificate
  • Duly filled up Form No. 29
  • Crime report of N.C.R.B.
  • Duly filled up Form No. 30

Procedure for Application of Transfer of Car Ownership in Delhi

After buying a pre-owned car, the first step on your side as a buyer is to transfer the ownership of the vehicle. This has to be done within the initial 30 days from the date of buying the vehicle. The procedure of transfer of ownership of a pre-owned car is rather simple

Step 1: No Objection Certificate (Conditional)

A No Objection Certificate must be procured from the RTO on buying a pre-owned car. However, you will need to get an NOC only if the vehicle that you have bought is registered in any RTO other than the local regional office. To attain the NOC, you must submit a properly filled Form 28 to the RTO where the car was originally registered. If the said car has been registered in any RTO outside the city of Delhi, you will need to submit Form 29 along with the same to the RTO where the vehicle was initially registered.

Step 2: Visit the RTO with the prescribed paperwork

To begin the procedure of transferring ownership of the pre-owned vehicle, you will need to visit the local RTO with the prescribed documents. The necessary set of paperwork that must carry with you includes:

  • original RC of the vehicle
  • copy of G.I.R
  • Form 29
  • Form 30
  • Two Form 35 (in case the vehicle has been hypothecated
  • Form 60 or Form 61 (applicable to cars only)
  • NOC, attested copy of proof of address
  • attested copy of the PUC certificate
  • attested copy of the valid driving license of the owner of the vehicle
  • Passport-size photos of the new owner
  • PAN card

In case the car ownership is being transferred from a company to an individual, a few other paperwork might be needed such as an authorisation letter and insurance proof.

Step 3: Submit all the documents

The regional office will have a fee structure for the RC transfer procedure. You will have to submit all the papers along with the prescribed surge fee for the transfer of RC of the vehicle. In general, the procedure takes around a month – 30 days. Once you get through all the formalities, you can check the status of the transfer process by visiting the official website.

Step 4: Re-register the vehicle (in case of inter-state transfer)

In case the car was initially registered in any RTO outside the state, the same has to be re-registered with the regional office of your region. For this, you will need to submit a set of papers that include the original RC of the vehicle, Form 20, Form 27, Form 33, Form 60 or Form 61, NOC, an attested copy of proof of address, attested copy of PUC certificate, attested copy of the valid driving license of the owner of the vehicle, passport size photos of the new owner, as well as PAN card.

Step 5: Pay the road tax

You will be asked to pay the road tax to the local regional office for re-registration of the car if the car you have bought was initially registered outside Delhi city. The payable road tax is calculated based on the price of the car as per the original invoice. It should also be noted in this regard that the new owner of the car will be eligible to file for a refund of the original road tax paid by the seller once he or she pays the tax after the transfer. The refund, in this case, is given depending on the actual price of the car and the age of the car. The new owner will also need to submit a set of papers to avail of the refund on the road tax.

With the procedure, you can easily and conveniently get a clear title for pre-owned cars. This could prove valid and necessary in bringing back the used car financing sums.
